By accessing or utilizing the Service, you affirm that you have read, comprehended, and consented to be bound by these Terms and our Privacy Policy. Should you not agree, you are prohibited from using the Service. We update our Terms of Service regularly.
Eligibility and Age Restrictions
The Service is exclusively intended for users who are thirteen (13) years of age or older.
- Users under 18: If you are under the age of eighteen (18), you represent that you have secured the requisite permission from your parent or legal guardian to use the Service, and that your parent or legal guardian agrees to be bound by these Terms on your behalf.
- Parental Responsibility: Parents or legal guardians of users under the age of eighteen (18) are solely responsible for monitoring and supervising their child’s activity on the Service.
Course Purchases, Payments, and Refunds
Payment Model
All course acquisitions are subject to a one-time, non-recurring fee for access to the specified digital content. Payment is required in full and upfront via our integrated payment processor (Paystack) to unlock the respective course content.
Seven-Day Money-Back Guarantee
We extend a seven (7) day money-back guarantee on any course purchased. To qualify for a full refund:
- The user must submit a written refund request to scholararkhq@gmail.com within seven (7) days following the original purchase date.
- The user must not have viewed or consumed more than ten percent (10%) of the total course content (including videos, supplemental resources, or CBT practice sessions).
Account Security and Device Policy
To safeguard the intellectual property of our contracted tutors and ensure the security of the Service, stringent account regulations are enforced:
- Device Switching: You are permitted to change your designated primary device only once every thirty (30) days. Attempts to log in on a second device within this 30-day period shall result in a temporary account suspension.
- License Tracking: We monitor and track your device ID for the purpose of enforcing the digital content license and preventing the unauthorized distribution of course materials.
Prohibited Activities and Termination
You are expressly prohibited from engaging in the following activities. Any breach of this section shall result in the immediate and permanent termination (ban) of your account without eligibility for a refund:
- Security Bypass: Attempting to circumvent the platform's security features, including, but not limited to, the DRM, offline mode encryption, or screen recording block.
- Content Theft: Attempting to modify the application, download, or otherwise distribute course videos or resources without authorization.
- Credential Sharing: Disclosing or sharing your confidential login details (username, password) with any other individual.
- Impersonation: Falsely representing or impersonating any other person, tutor, or ScholarArk employee or staff member.
- Hacking: Attempting to disrupt, degrade, or overburden the Service, the database, or image hosting infrastructure.
Content and Intellectual Property
ScholarArk Content
All content provided by ScholarArk, including the application interface, design, source code, and logo, remains the proprietary property of ScholarArk LTD.
Tutor Content Disclaimer
Tutors, not ScholarArk, bear full responsibility for the content, accuracy, quality, and delivery of their teaching materials, videos, and CBT questions. ScholarArk LTD expressly disclaims responsibility for the accuracy or substance of teaching materials provided by its contracted tutors.
License to View
Upon the purchase of a course, you are granted a limited, non-exclusive, non-transferable license to view the course content solely through the ScholarArk platform for your personal, non-commercial use. This license does not convey any ownership rights to the course materials.
Account Deletion
Users may request their account be deleted alongside all data provided by the user by sending an email to scholararkhq@gmail.com, clearly stating the request for account and data deletion. Please Note that some data may be retained as required for financial reports and third party services.
